DEA rescheduling hearing begins

The U.S. Drug Enforcement Administration’s (DEA) long-anticipated rescheduling hearings began amid controversy, before evidentiary hearings were postponed until January.

“Remember, everybody, this is not a trial about whether marijuana is good or marijuana is bad—because I don’t know whether it’s good or it’s bad,” DEA Administrative Law Judge John Mulrooney said. “My issues are much more narrow than that, and has to do with with addiction potential and several other little pigeon holes that I have.”

While the DEA is proposing that cannabis be moved to schedule III, an attorney representing a Connecticut agency said that the DEA’s position on the issue is not clear. The DEA has not yet provided a list of exhibits that it plans to use in the hearing.  The judge scolded the agency and directed it to provide the list this week.

Meanwhile groups of reform-supporting health professionals and veterans have sued after they were excluded from the hearings.

SEPARATELY: A federal appeals court seemed skeptical of high-profile attorney David Boies’ argument that cannabis prohibition is unconstitutional.
